MusicWorks Instrument Hire Terms & Conditions
The Hirer Agrees
(MW means MusicWorks Ltd)
1. PAYMENT: To pay the monthly instrument rental and, if chosen, insurance each month. I consent to the use of my credit card should payment be overdue. Unpaid accounts will incur collection and legal fees to be paid by the hirer.
2. GOOD CONDITION: The instrument and case are to be kept in good working order and condition during the rental period. MW reserves the right to cancel the contract should the instrument show signs of neglect or abuse. The hirer hereby agrees to indemnify MW for making good damage caused by abuse or neglect.
3. RETURN: The instrument may be returned to the MW Dealer that the instrument was hired from at any time after the three months form commencement of hire and all monies due under this agreement must be paid up to and including the date of return. The hirer is responsible for all freight charges to that MW Dealer.
4. PROPERTY: The instrument remains the sole property of MW and title shall not pass to the hirer until all purchase payments and other monies payable under this agreement have been paid in full.
5. DEFAULT AND REPOSSESSIONS: If the hirer is in default under any clause in this agreement then MW and I or its agents may without notice or demand forthwith take possession of the instrument, case and any other items affixed to or contained within the instrument or case.
6. INDEMNITY: The indemnity MW against all cost, whether commissions, legal fees or otherwise, incurred by MW or their duly authorised agents relating to the recovery of any monies, goods or services that may be outstanding from time to time pursuant to the terms of this agreement.
7. PURCHASE: If within the period of the Hire, the Hirer purchase the rental instrument or any instrument of equal or greater value, then the following consideration is offered to the hirer: a) Monthly Hire Plan: If purchased at any time up to the 12 months of the commencement of hire, deduct all rental monies paid (not insurance) from the retail price of the instrument hired, and pay the balance. b) If purchased anytime after 12 months of commencement of rental, deduct first 12 months hire payments only, (not insurance) from the retail price of the instrument hired and pay the balance. c) School Year Plan: If purchased at any time up to the 20th December of the year that the hire was commenced, deduct first year's rental (not insurance) from the retail price of the instrument and pay the balance. d) If purchased anytime after the 20th December of the year that the hire was commenced, deduct the first year's rental only (not the insurance) from the retail price of the instrument hired and pay the balance.
8. TRAVEL: The instrument may not be taken overseas without the permission of MW.
9. PRIVACY ACT: I/We authorise any person or company to provide MW with such information as may be required in response to credit enquiries, and to authorise MW to finish to any third party details of this applications and subsequent dealing that the hirer may have as a result of this application being actioned by MW.
10. INSURANCE: Insurance is optional. You may choose to insurance with your own company. However, the hirer agrees that if insurance is taken from a company other than MW, the hirer is responsible for the care of the instrument and will indemnify MW for the purchase price of the instrument should the instrument be lost, stolen or damaged beyond repair. In the event of damage or maintenance being required, the hirer agrees to forward the instrument to the MW Dealer where the instrument and the hirer agrees that repairs will not be done other than by MW. Unauthorised repairs, which need to be made good will be at the cost of the hirer.
11. MINIMUM TERM: The minimum monthly hire is three months.
12. SCHOOL YEAR HIRE: School Year Hire finishes on December 20th, regardless of the date at which the contract starts. For any instrument not returned on or before December 20th, rental will be charged at the monthly rental rate for that instrument.
Insurance
SERVICE: MusicWorks (MW) will do any service necessary to keep your instrument in proper playing condition.
MUSICWORKS INSURANCE: If this option is taken your hired instrument is covered against fire, theft, total loss or accidental damage. Abuse or neglect is not covered, see 'ITEMS NOT COVERED'
THEFT: In the event of theft, you must bring us the original copy of the police report covering the facts of the theft. The instrument will then be replaced with one of like age, condition and value.
FIRE AND ACCIDENTAL DAMAGE: MW will either repair satisfactorily or replace the instrument with one of like age, condition and value, at the discretion of MW.
ITEMS NOT COVERED: Any condition that does not affect the playing performance. Repairs not done by MW or their appointed agents. Refinishing of lacquer and plated finishes. Consumables that would be used in the normal operation or upkeep ( Strings, Reeds, Oils, Cork Grease, Swabs, Sticks, Rosin, etc) Accessories supplied with the instrument when you hired: you are liable for lost neck straps, mouthpieces, ligatures, caps, cleaning rods, bows, shoulder pads, etc. (You are not liable for consumables above)
EXPIRY OF COVER: Instruments are covered only for the period plan paid for. Covered lapses when payments are overdue. In the case of Fire or Theft, instruments will only be replaced once.
